Leave Entitlements

Annual Leave
Under the BCEA, every employee is entitled to 21 consecutive days of annual leave per year (for a 5-day work week, that's 15 working days). Leave accrues from the first day of employment.
For employees working fewer than 5 days per week, the entitlement is calculated as: 1 day of leave for every 17 days worked.
Sick Leave
In every 36-month cycle, an employee is entitled to the equivalent of 6 weeks' paid sick leave. For a 5-day worker, that's 30 working days over 3 years. In the first 6 months of employment, sick leave is limited to 1 day per 26 days worked.
An employer may require a medical certificate if the employee is absent for more than 2 consecutive days, or if absent more than twice in 8 weeks.
Family Responsibility Leave
Employees who have been employed for more than 4 months and work at least 4 days per week get 3 days per year for:
- When a child is born
- When a child is sick
- Death of a spouse, life partner, parent, adoptive parent, grandparent, child, adopted child, grandchild, or sibling
Maternity & Paternity Leave
Maternity leave: 4 consecutive months (unpaid by the employer, but the employee can claim from UIF). Must start at least 4 weeks before the expected due date.
Paternity leave: 10 consecutive days from the date of birth.
